Prosecutors say a Janesville man who caused a fatal crash in April of 2023 was not only drinking that night, but had a history of crashing his vehicle after falling asleep at the wheel.
During closing arguments at 50-year-old Mark McCoy’s jury trial this week Assistant District Attorney Rich Sullivan said that a witness testified that the defendant had been in three prior crashes after falling asleep while driving.
McCoy’s blood test, which was done hours after the crash, and after he had been administered IV fluids did come back under the legal limit.
After three days of testimony and deliberating for more than four hours a Rock County jury found McCoy guilty of second degree reckless homicide and homicide by negligent operation of a vehicle. Judge Ashley Morse only entered a finding of guilty on the reckless homicide charge, as the second charge would be considered a lesser version of the first.
McCoy faces up to 25 years in prison at sentencing on March 14th.
